Paul Downes QC, Di Resta’s counsel, accused Hamilton of giving “totally
misleading” evidence last week. “Incorrect. I personally had not
been paid but my company had been paid,” Hamilton replied.

“No,” Downes said. “It was a false answer and there is no
conceivable way you could have forgotten, I suggest to you.”

Hamilton, who has been accused of lying and of falsifying evidence by “backdating”
emails and draft notes, added that the trial could have been prevented had
Di Resta simply “done the decent thing” and apologised to him.

“He should have been decent,” Hamilton said. “Don’t start
accusing people of fraudulent behaviour when you can’t prove it. A sorry
would have done.”

The trial is expected to finish next week with a judgement not expected until
mid-January.
